Alrighty then...!

Barring some kind of unexpected emergency (knock on my wooden head) I believe I've gotten the last medical appointment out of the way until after the exam. Unfortunately, it took up most of my day.

I did manage to get my assigned BarBri Torts essay in to be graded. Then I checked out the score sheet they use, and it looks like the term "graded" is not quite an accurate description of what's going to happen to it. They assign different rankings to the different elements of the answer. The rankings are "Above Average", "Pass" and "Fail" for each of the four elements, which include "Issue Spotting", "Rule Statements", "Analysis", and "Organizational Format".

Fair enough, I suppose. As long as the "rankings" are realistic. One of my main complaints during school was that I could never get a feel for whether the scores we received on our essays were even remotely in line with what we might expect to receive if it were graded by a Bar examiner. I suppose that was a good thing too. Now that I'm here, I don't even want to look at some of the stuff I turned in during my first and second year.

Anyway, I'm kind of anxious to see what they say about this effort.

I went off topic a bit and talked about misrepresentation. I mean, the man pretended to be a doctor, even though he didn't make a false statement.

There was definitely an element of fraud involved. I guess the only question was what to call it. I used it in a few places... One was to show lack of consent by Ed. Another was to help show intent for IIED. Then I mixed it into the analysis for each of the Invasion of Privacy issues.

I talked about misrepresentation too, but said it was unlikely because of the lack of an affirmative statement - though the BarBri notes say something like "silence is NORMALLY not enough." I completely missed IIED - I think because damages (mental or otherwise) weren't mentioned. Anyways...

I heard that BarBri grades the essays overly hard so you think you did worse than you did and therefore study more. It'll be interesting to see how this pans out when we get them back.

Exactly. And I always think my paper is perfect when I'm done with it and then I'm shocked (SHOCKED!) when it comes back with an average grade. The nerve of those people!
