Two down. One to go.

Today was what I expected. I got all of them right. I answered either A, B, C or D, for all of the MBEs. Yep. Aced that one, I did.

The funny thing about MBEs is that I'm always surprised when I miss one. I don't mean to say that I don't expect to miss any. I just mean that before I pick an answer I think about the question, fill in the bubble for the one I think is right, then move on. I believe I've always picked the right answer, even on the ones that are mostly a guess. That's probably a character flaw.

Tonight I'm going to study up on CA Civ Pro, Corps (10b5, 16b, Agency), and Con Law (Commerce Clause, Equal Protection, Due Process and based on the headlines these days I should probably look at something to do with the free speech rights of illegal aliens! (ahem... pardon me, "undocumented guest workers")).

I don't think they're going to give us a Crimes problem because if they were, I think they would have done that with a Crim Pro/Evidence crossover, and Crim Law is not likely. But they might sneak in a Contracts problem coupled with Agency and Partnerships because after that Torts thing on Tuesday, who really knows?

And then many people are predicting Community Property, Wills and Trusts all wrapped up in one. Or how about this... A Con Law question that starts in a California State court then gets removed to federal court with diversity or a federal question. That could get nasty.

Remedies is probably off the board unless they couple it with Corps or the aforementioned unanticipated Contracts problem.

And then of course there's likelihood of a full PR problem.

Alrighty then. It's settled. I'm going to go back over everything but Torts, Property, and Evidence.

As far as tomorrow's PT goes, I'm just going to have to pray for Divine Intervention.

It's going to be a long night, but it'll be the last one for a week or so. I'm going to take at least a week off before I start studying again for February.

I'm such an optimist!

I have the same character flaw. I get very attached to my answer choices even if I have no rational basis for them. And Poobah-- you're really going to start studying for the Feb exam after this?? I have faith in you even if you don't have it in yourself : )

It is really crazy that we have to wait until November. FL's results come out on Sep 17th! Damn the CA bar committee, damn them!
I am wondering how I am going to stop worrying. I suppose your body just tires of worrying and you forget about it after a couple of months. Hmmm?

Amanda: Yep... I was thinking about decommissioning the study dungeon, but then I decided to keep it operational until November. And if it's there, I might as well stay fresh. I won't be studying at the same pace as I have been over the past couple of months but I'll kick myself hard if I lose too much of the trivia that's in my head right now.

2/3!!!: It's like when I was a kid after Christmas. In February, Christmas is so far away that I'll drive myself crazy if I don't put it out of my mind. That's what we have to do now. It should be easy. For a week or two anyway! (;-)>

Heyyy I got the same answers as you again!! lol - so hard to tell if you did ok on MBE's - overall... i answered em all and that is all im gonna say! lol

I dont know what you guys think, but I thought the MBEs were MUICH HARDER THAN I ANTICIPATED.

They tried real hard to make 50 questions have two right answers. I was like what the fuck; when there are two right answers I go back and read the facts and realize why one "right" one is really wrong.

They made us make too many factual judgments.

Now I know why the national average is 130 or so.

I thought this was my time to create some separation; give myself a chance to make the post-season. But now, fuck, tomorrow, we are going to get bent over prisoner style (posing a undue hardship atypical to the ordinary incidents of prison life).

There is one question that is killing me... can you be guilty as an accomplice if the criminal doesn't know that you are trying to help him. I tried really hard to remember from first year and ended up saying no. What do you guys think?

The MBE seemed hard. I also felt there were a lot of close questions with two answers. And a lot of factual distinctions. Bleh.

I agree the MBE seemed hard...WAY more crim pro than Barbri told us would be on there.
And ademption?! Thought that was more of a W&T thing, but whatever...

Yep. As a general observation, there seemed to be a lot of MBEs on the non-MBE subjects.

I read pretty quickly, and my comprehension is above average, but I had to re-read many of these many times. Too many times for comfort.

As for the Wills questions - I am hoping that those are some of the 10 "experimental" ones that won't be graded. Maybe they are thinking of making it the big 7?

Anon: I believe you're referring to the Rule in Dumpor's Case. I ran into this a few months ago while doing MBEs. Here's the rule that I found ...

It's an English rule that provides that if a landlord consents to one assignment of the lease by the tenant, the landlord consents to all subsequent assignments; most states have abolished by statute the effects of this rule.

The other confusing part of that accomplice question was that the act of the possible accomplice didnt even end up helping the criminal. I guessed that she wasnt an accomplice, but I have no real basis for it.

Anyone else notice a lot of contract damages questions? There were way more of those than I expected.

Thanks BarBri for all those assignment, 3PB, and RAP MBEs. That covered approximately 2/200. Thanks for not covering so many of the topics that were actually tested. Where I was thinking "gee, I remember going over that in class 3 years ago which is the last time I thought about it. Too bad I can't remember the rule."

All that is required for accomplice liability is that you aid, counsel or encourage the principal with the intent of bringing about the completion of the underlying crime - with that in mind - of course you can be liable as an accomplice even if the principal isn't aware! as long as you have the required mental state and you aid, counsel, or encourage - there is no requirement that the principal be aware.
